Do not submit protected health information
Website forms are ordinary, unsecured web forms. Do not enter patient names, dates of birth, medical record numbers, diagnoses, or other protected health information. Call (360) 383-5945 to coordinate shipments that require that information.
Requests are not confirmations
Submitting a pickup or quote request creates a request only. No transportation is scheduled, reserved, or guaranteed until TyVia confirms it with you directly. Do not rely on a submitted form for time-sensitive transportation until you receive that confirmation.
Customer responsibilities
You are responsible for properly packaging, sealing, labeling, and preparing every shipment in accordance with applicable legal, regulatory, and carrier requirements, and for providing accurate and complete pickup and delivery information, contacts, and access instructions. You are responsible for ensuring that a shipment is lawful to transport and appropriate for the service requested.
Items we do not transport
We do not accept cash, negotiable instruments, controlled substances outside a lawful and agreed arrangement, hazardous materials outside our stated capabilities, live animals, firearms, or any item prohibited by law. Tell us in advance if a shipment may fall into a restricted category.
Service availability and pricing
Availability, timing, coverage area, and pricing depend on location, request details, and capacity, and may change. Rates quoted through this website are estimates unless confirmed in writing. Specific service commitments, service levels, and pricing are set out in the written arrangement between TyVia and the customer, which controls if it conflicts with these terms.
Cancellations and access
Please cancel or modify a request as early as possible. Attempted pickups that cannot be completed because a shipment is not ready, a location is inaccessible, or a recipient is unavailable may be subject to a charge under your service arrangement.
Website use
You agree not to misuse this website, including by submitting false information, attempting to gain unauthorized access, interfering with its operation, or submitting automated or abusive volumes of requests. We may limit or block submissions to protect the service.
Disclaimers
This website and its content are provided on an "as is" and "as available" basis. To the fullest extent permitted by law, HolmesLabs LLC disclaims all warranties relating to this website, whether express or implied, including warranties of merchantability, fitness for a particular purpose, and non-infringement. Nothing on this website constitutes legal, medical, or regulatory advice.
Limitation of liability
To the fullest extent permitted by law, HolmesLabs LLC is not liable for indirect, incidental, special, consequential, or punitive damages, or for lost profits or lost data, arising from your use of this website. Liability for transportation services is governed by the written service arrangement between TyVia and the customer. Nothing in these terms limits liability that cannot be limited under applicable law.
Governing law
These terms are governed by the laws of the State of Washington, without regard to its conflict-of-law rules. Any dispute relating to this website will be brought in the state or federal courts located in Washington.
Changes
We may update these terms from time to time. Continued use of the website after an update constitutes acceptance of the revised terms.
